Terms and Conditions for Waiola Surf Academy

Welcome to Waiola Surf Academy

Please read these Terms and Conditions carefully before participating in our surf lessons and

activities. By booking or participating, you agree to these terms.

1. Booking and Payment

- All bookings must be made in advance via our website, phone, or in person.

- Full payment is required at the time of booking unless otherwise agreed.

- We accept [PayPal, Venmo, Debit and Credit Cards].

2. Cancellations and Refunds

- Cancellations made [3] days in advance are eligible for a full refund or reschedule.

- Cancellations made less than [3] days before the scheduled lesson may incur a fee or

be non-refundable.

- We reserve the right to cancel lessons due to weather, safety concerns, or other unforeseen

circumstances; in such cases, a full refund or reschedule will be provided.

3. Safety and Responsibility

- Participants must follow all safety instructions given by our instructors.

- Surfing can be a fun activity but without the proper guidance surfing can also be a risky

activity. Participants acknowledge the inherent risks involved.

- You agree to participate at your own risk and release Waiola Surf Academy, its staff, and

affiliates from liability for injuries or damages, except where caused by gross negligence or

willful misconduct.

4. Health and Fitness

- Participants should be in good health and capable of participating in physical activities.

- If you have medical conditions, injuries, or concerns, inform us prior to the lesson.

- All Participants must be able to swim. NON SWIMMERS will NOT be able to participate in our

ocean activities

5. Age Requirements

- Participants must be at least 4 Years old. Minors within the ages of 4-8 are required to book a

“Private Surf Session”.

6. Equipment

- We provide surfboards and safety gear. Participants are responsible for returning equipment in

good condition.

- Any damage caused by misuse may incur charges.

7. Photos and Videos

- By participating, you grant permission for Waiola Surf Academy to take photos and videos for

promotional purposes, as outlined in our **Photo and Video Release** clause (see our Privacy

Policy).

8. Cancellation or Rescheduling by Us

- We reserve the right to cancel or reschedule lessons due to weather, surf conditions, or safety

concerns.

- In such cases, we will notify you as soon as possible and offer alternative dates or refunds.

9. Personal Responsibility and Conduct

- Participants agree to behave responsibly and follow instructor instructions.

- Any disruptive or unsafe behavior may result in removal from the lesson without refund.

10. Changes to Terms

- We may update these Terms and Conditions at any time. Changes will be posted on our

website.

11. Governing Law

- These terms are governed by the laws of the United States in the State of Hawaii. Any

disputes will be resolved in the courts of Hawaii, Maui.
